General Terms and Conditions of Sale

1. Purpose

These Terms and Conditions govern the legal relationship arising from the purchasing processes formalized by Customers through the Website and apply to the purchase of any product listed on the Website. Unless otherwise indicated, the Customer may conduct the purchase transaction in the same language as these General Terms and Conditions of Sale.

Without prejudice to the provisions of these Terms, the buyer is entitled to the legal guarantees provided under current legislation according to the nature of the product. For purchases made in Spain, the provisions of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007 of November 16, will apply.

2. Purchase Conditions

To place an order on OtakuDolls.com, the user must connect to the website https://otakudolls.com and either register or identify themselves as a user by completing the identification or registration form displayed on the store and following the instructions provided on the website.

The validation of the order by the user constitutes explicit acknowledgment of these Terms of Sale and acceptance of the same as the terms of the sales contract. Unless proven otherwise, the data recorded by the company constitutes proof of the transactions carried out between the company and its customers.

Otaku Dolls reserves the right to modify these conditions in the future. In such cases, the revised sales conditions will only apply to orders validated by the Customer after the updated terms are published on the Website. Therefore, we encourage Customers to review the latest version of the sales conditions before placing a new order.

After the ordering process is completed, the company will send a purchase confirmation to the user as soon as possible, via the email address provided during registration or identification.

3. Customer Access and Registration

Access to services requires prior registration by users, who must accept the Privacy Policy and Cookie Consent, thereby becoming Customers.

The Customer guarantees that they are of legal age and have the legal capacity to enter binding agreements and, therefore, to accept the Terms of Use of this Website and purchase our Products. Furthermore, the Customer is responsible for ensuring the information provided during registration is true, accurate, complete, and up-to-date.

The Customer’s identifier will consist of their email address and a password. To access their account, the Customer must use this identifier and a password containing a minimum of 4 characters.

The password is personal and non-transferable, and its sharing, even temporarily, with third parties is not permitted. The Customer commits to diligent use and secrecy of their password, assuming full responsibility for any consequences of its disclosure to third parties.

If the Customer suspects or becomes aware of third-party use of their password, they must immediately change it as outlined on the Website.

All purchases made through the Website using the username and password will be considered validly made by the Customer and will be binding. Therefore, the Customer is solely responsible for any purchases made through the Website by third parties using their password.

Purchases made on the Website by individuals who do not meet the legal age requirement of their country and who provide false registration information are presumed to be made under the supervision and authorization of their parents, guardians, or legal representatives.

Otaku Dolls will not permit any transaction that is illegal or deemed harmful to the goodwill of credit card brands or acquiring banks. Prohibited activities under card brand programs include the sale or offering of products or services that are not fully compliant with applicable laws for the Buyer, Issuing Bank, Merchant, or Cardholder. Explicitly prohibited activities include:

• “Child pornography, violence/hate, and extreme sexual violence.”

4. Proper Use of Services

The Customer agrees to use the services diligently, correctly, and lawfully and, by way of example but not limitation, undertakes to:

(a) Not use the Services for purposes contrary to the law, morality, generally accepted good customs, or public order.

(b) Not reproduce, copy, distribute, make publicly available, transform, or modify the Services unless authorized by the rights holder or legally permitted.

(c) Not engage in any act that may constitute an infringement of intellectual or industrial property rights belonging to the company or third parties.

(d) Not use the services or information obtained through the Website to send unsolicited advertising or communications for direct sales or other commercial purposes, regardless of intent, or to commercialize or disclose such information.

The Customer will be liable for any damages of any nature caused to the company as a result of the breach of these obligations or any other obligations included in these General Terms or imposed by law regarding the use of the Website.

The company will ensure compliance with current legislation and reserves the right to interrupt the service or exclude the Customer from the Website at its sole discretion in cases of alleged commission of crimes or misconduct or behaviors contrary to these Terms, the contracting conditions of the Website, the law, or the rules established by the company or its collaborators.

5. Product Availability

The selection of products offered by Otaku Dolls is valid while the products are visible on the Website and within the limits of available stock.

Users will be informed as soon as possible if a product becomes out of stock or temporarily unavailable. This does not constitute a binding commitment by the company to maintain availability.

In the case of stock shortages or temporary unavailability, the company will notify affected customers via email to propose a new delivery date or cancel the order and issue a refund when necessary.

For orders containing multiple items with different availabilities, the delivery time will align with the longest delivery estimate. The company reserves the right to split shipments in exceptional cases.

Delivery delays do not entitle the Customer to claim compensation.

Otaku Dolls reserves the right to cancel an order if a typographical error indicates a manifestly incorrect price.
